These Terms of Service govern your purchase and use of Affimerce products, including TradingView invite-only indicators, research tools, educational content, and related services.
By purchasing, accessing, or using Affimerce products, you agree to these Terms.
1. Educational and Research Purpose Only
Affimerce indicators, tools, charts, articles, and related materials are provided for educational and market research purposes only.
Affimerce does not provide financial, investment, trading, tax, legal, or accounting advice. Nothing provided by Affimerce, LLC should be interpreted as a recommendation to buy, sell, hold, short, or trade any security, cryptocurrency, futures contract, option, currency, or other financial instrument.
You are solely responsible for your own investment and trading decisions.
2. No Investment Advice or Guaranteed Results
Affimerce Indicators are designed to help users organize market, valuation, technical, volume, and financial information. They do not predict future returns and do not guarantee profitable outcomes.
Past performance, historical signals, backtests, examples, screenshots, or model results do not guarantee future results.
Trading and investing involve risk, including the possible loss of capital. You agree that Affimerce, LLC is not responsible for any trading losses, investment losses, missed opportunities, tax consequences, or financial damages resulting from your use of Affimerce products.
3. TradingView Access
Affimerce Indicators are provided through TradingView invite-only script access. To activate access, you must provide the correct TradingView username during checkout.
Access is granted manually and may take time to process. Affimerce is not responsible for delays caused by incorrect usernames, TradingView account issues, TradingView platform changes, or third-party service interruptions.
You are responsible for maintaining your own TradingView account.
4. No Source Code Provided
Affimerce products do not include Pine Script source code.
Purchasing access permits you to use the invite-only indicators through TradingView. It does not give you ownership of the underlying code, formulas, logic, models, data structure, scripts, design, or intellectual property.
You may not copy, reverse engineer, reproduce, modify, redistribute, resell, share, sublicense, publish, or attempt to extract the source code or logic of any Affimerce indicator.
5. License and Permitted Use
Your purchase grants you a limited, non-exclusive, non-transferable, revocable license to use the purchased Affimerce indicators for your own personal or internal research use.
You may not share your access with another person, trading group, paid community, company, fund, or organization unless Affimerce gives written permission.
Affimerce may revoke access if we believe your account is being shared, abused, resold, copied, or used in violation of these Terms.
6. Refund Policy
Except as required by applicable law, all paid purchases and subscription renewals are final and non-refundable. This policy applies to Monthly, Annual, and Three-Year plans.
If your selected plan includes a free trial expressly offered at checkout, you may cancel before the trial ends to avoid the first subscription charge. Once a paid charge has been processed, Affimerce does not offer refunds, partial refunds, prorated refunds, or exchanges, except where required by applicable law.
Affimerce products are digital services provided through TradingView invite-only access. Access activation is handled as described in Section 3.
Subject to applicable law, refunds are not provided solely because of mistaken purchases, unused access, an incorrect TradingView username, dissatisfaction with market results, changes in personal trading needs, or failure to cancel before the end of a free trial or before a renewal date.
Cancellation prevents future renewal charges as described in Section 7. It does not automatically entitle you to a refund for a charge already processed or for unused time in a prepaid subscription period.
To the extent permitted by applicable law, interruptions, limitations, account restrictions, platform changes, data interruptions, service outages, or service discontinuation caused by TradingView or other third-party providers outside Affimerce’s control do not, by themselves, create a right to a refund.
Nothing in this Refund Policy excludes or limits any refund, cancellation, or other consumer rights that cannot be excluded under applicable law.
7. Subscriptions, Free Trials, and Billing
Available Plans
Affimerce currently offers Monthly, Annual, and Three-Year subscription plans. Plan prices, included products, available promotions, and any applicable free trial are disclosed on the pricing page and at checkout.
A Monthly plan covers a one-month subscription period. An Annual plan covers a twelve-month subscription period. A Three-Year plan covers a thirty-six-month subscription period.
Billing and Automatic Renewal
Unless expressly stated otherwise at checkout, subscription fees are charged in advance for the full selected subscription period.
Monthly plans renew every month, Annual plans renew every twelve months, and Three-Year plans renew every thirty-six months, unless canceled before the applicable renewal date.
By completing checkout and expressly agreeing to recurring billing, you authorize Affimerce and its payment processor to charge your selected payment method for the initial subscription and subsequent renewals according to the billing terms disclosed to you.
Any equivalent monthly rate displayed for an Annual or Three-Year plan is provided for price comparison only. It does not mean that the plan is billed monthly. The actual amount charged and billing frequency are disclosed at checkout.
Free Trials
All plans may include a seven-day free trial when expressly offered at checkout.
The applicable trial duration, first payment amount, and billing schedule will be disclosed before you subscribe.
Unless you cancel before the free trial ends, your selected plan will automatically convert to a paid subscription, and your payment method will be charged for the full subscription period selected at checkout.
Cancellation and Subscription Management
You may cancel your subscription or free trial through the Stripe customer portal provided by Affimerce. If you need assistance accessing the portal or canceling, contact affimerce@gmail.com.
Cancellation of a paid subscription stops future automatic renewals. Unless your access is suspended or terminated under these Terms, you may continue using the purchased products until the end of your current paid subscription period.
To avoid the first subscription charge, you must cancel a free trial before it ends. Any remaining trial access will be handled according to the trial terms disclosed at checkout or in your cancellation confirmation.
Stopping use of the indicators, removing them from a TradingView chart, or deleting an Affimerce-related email does not cancel your subscription.
You are responsible for reviewing your billing information and managing your subscription before the applicable trial-end or renewal date. Refunds are governed by Section 6 and applicable law.
8. Subscription Term and Access
Access purchased under a Monthly, Annual, or Three-Year plan is limited to the applicable trial or paid subscription period, subject to these Terms.
Your applicable subscription period and renewal date are shown in your billing records or subscription management portal. Continued access after the end of a paid subscription period requires a valid renewal or a new purchase, unless otherwise agreed in writing.
Affimerce Indicators depend on TradingView, Pine Script functionality, invite-only script access, account permissions, market and financial data availability, and other third-party services. Access may be affected by changes or limitations involving these dependencies, as described in Sections 9 and 10.
A subscription does not guarantee that any particular indicator, feature, formula, data source, integration, or access method will remain unchanged throughout the subscription period.
Nothing in this section excludes or limits rights that cannot be excluded under applicable law.
9. Product Changes
Affimerce may improve, modify, remove, rename, or discontinue indicators, features, pricing plans, educational content, or website pages at any time.
We may make changes due to TradingView updates, Pine Script changes, data availability, business decisions, technical limitations, or compliance reasons.
Changes to subscription pricing do not retroactively increase the price already paid for the current subscription period. Pricing changes may apply to new purchases or future renewals. We will disclose applicable renewal price changes before they take effect and provide any notice or consent process required by applicable law.
Discontinuing a pricing plan for new purchases does not, by itself, shorten an existing paid subscription period.
10. Third-Party Platforms and Data
Affimerce products may depend on TradingView, Stripe, market data providers, financial data sources, and other third-party services.
Affimerce does not control these third parties and is not responsible for their downtime, data errors, platform changes, account restrictions, pricing changes, or service interruptions.
11. Accuracy of Information
Affimerce aims to provide useful and accurate research tools, but we do not guarantee that any indicator, calculation, score, data point, article, chart, or output is complete, current, error-free, or suitable for your specific purpose.
You should independently verify all information before making any financial decision.
12. Limitation of Liability
To the maximum extent permitted by law, Affimerce and its owners, employees, contractors, affiliates, and representatives shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or financial damages arising from your purchase or use of Affimerce products.
This includes, but is not limited to, trading losses, investment losses, lost profits, lost data, business interruption, subscription costs, platform issues, or reliance on any indicator, score, signal, article, or analysis.
13. No Professional Relationship
Your use of Affimerce products does not create an advisor-client, fiduciary, broker-client, attorney-client, accountant-client, or other professional relationship.
14. User Responsibility
You agree that you are responsible for evaluating whether Affimerce products are suitable for you, understanding the risks of investing and trading, verifying information independently, managing your own TradingView account, providing the correct TradingView username, canceling subscriptions before renewal if you no longer want access, and complying with applicable laws and regulations.
15. Intellectual Property
All Affimerce indicators, scripts, designs, names, logos, content, layouts, formulas, models, scores, text, images, and website materials are owned by Affimerce or its licensors.
You may not reproduce, distribute, sell, publish, or create derivative works from Affimerce intellectual property without written permission.
16. Termination
Affimerce may suspend or terminate your access without refund if you violate these Terms, misuse the products, attempt to copy or reverse engineer the indicators, share access, dispute payments in bad faith, or engage in abusive or fraudulent behavior.
17. Changes to These Terms
Affimerce may update these Terms from time to time. The updated version will be posted on this page with a new Last updated date.
Continued use of Affimerce products after changes are posted means you accept the updated Terms.
